Agreement to Terms

By accessing or using Onemyle's creator platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

User Accounts

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account

Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Harm to other users or our platform
• Any other reason at our sole discretion

Content and Conduct

Your Content

• You retain ownership of the content you create and post
• By posting content, you grant us a license to use, display, and distribute it on our platform
• You are solely responsible for your content and the consequences of posting it
• You must have the rights to any content you post

Prohibited Content and Conduct

You may not post content or engage in conduct that:

• Violates any law or regulation
• Infringes on intellectual property rights
• Contains hate speech, harassment, or discrimination
• Promotes violence or illegal activities
• Contains spam, malware, or phishing attempts
• Impersonates another person or entity
• Violates others' privacy or publicity rights

Creator Responsibilities

As a creator on our platform, you agree to:

• Create original, high-quality content for your local community
• Accurately represent your partnerships and sponsored content
• Comply with all applicable advertising and disclosure laws
• Respect intellectual property rights
• Maintain professional conduct with businesses and other users

Business Partnerships

Platform-Mediated Relationships

• No Direct Arrangements: Onemyle does not permit or facilitate direct business arrangements between creators and businesses. All engagements must go through the Onemyle platform.
• Separate Engagements: Creators engage with Onemyle as a platform, and businesses likewise engage with Onemyle directly, but these are separate and independent relationships.
• Onemyle as Platform: Onemyle is the party to both relationships and facilitates interactions between creators and businesses when necessary for campaign execution.
• Sponsored Content Disclosure: All sponsored or paid content must be clearly disclosed in accordance with applicable advertising and disclosure laws.

Payments

• Business-to-Platform: Businesses pay Onemyle directly for access to the platform and creator campaigns.
• Platform-to-Creator: Onemyle pays creators separately for their participation, contribution, and content creation.
• Independent Payment Terms: Payment terms between Onemyle and businesses are separate and independent from payment terms between Onemyle and creators.
• Tax Responsibility: You are responsible for reporting income received from Onemyle and paying all applicable taxes.
• No Creator-Business Payments: Creators should not accept direct payments from businesses for any Onemyle platform activities. All compensation must flow through Onemyle.

Intellectual Property

Platform Content

All content on the platform, including design, text, graphics, logos, and software, is owned by Onemyle or its licensors and is protected by intellectual property laws.

Trademark Policy

You may not use Onemyle's trademarks, logos, or brand elements without our prior written permission.

Third-Party Links and Services

Our Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding availability, accuracy, or reliability
• Warranties that the service will be uninterrupted or error-free

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONEMYLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

• Your use or inability to use the Service
• Loss of profits, data, or goodwill
• Unauthorized access to your account or content
• Errors or omissions in any content
• Any other matter relating to the Service

Indemnification

You agree to indemnify and hold harmless Onemyle and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your content or conduct
• Your violation of these Terms
• Your violation of any rights of another party

Dispute Resolution
